# Dataset License - Mimics, Muscles, and Me (MMM)

Please read carefully the following terms and conditions and any accompanying documentation before you download and/or use the "Mimics, Muscles, and Me" dataset, and software (the "Dataset").
By downloading and/or using the Dataset, you acknowledge that you have read these terms and conditions, understand them, and agree to be bound by them.
If you do not agree with these terms and conditions, you must not download and/or use the Dataset.

## Ownership

The Dataset has been developed at the Computer Vision Group Jena at the Friedrich Schiller University Jena (hereinafter "CVG") in joint cooperation with the Ear-Nose-Throat Department at the University Hospital Jena and is owned by and proprietary material of the Computer Vision Group Jena.

## License Grant

The MMM dataset is under a [Attribution-NonCommercial 4.0 International](https://creativecommons.org/licenses/by-nc/4.0/).
Hence, CVG grants you the right to share and adapt the model for any purpose, excluding commercial use under following terms:

- **Attribution** — You must give appropriate credit , provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.
- **NonCommercial** — You may not use the material for commercial purposes .
- **No additional restrictions** — You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.

## Disclaimer of Representations and Warranties

You expressly acknowledge and agree that the Dataset results from basic research, is provided “AS IS”, may contain errors, and that any use of the Dataset is at your sole risk.
CVG MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE DATASET, NEITHER EXPRESS NOR IMPLIED, AND THE ABSENCE OF ANY LEGAL OR ACTUAL DEFECTS, WHETHER DISCOVERABLE OR NOT.
Specifically, and not to limit the foregoing, CVG makes no representations or warranties
(i) regarding the merchantability or fitness for a particular purpose of the Dataset,
(ii) that the use of the Dataset will not infringe any patents, copyrights or other intellectual property rights of a third party, and
(iii) that the use of the Dataset will not cause any damage of any kind to you or a third party.

## Limitation of Liability

Under no circumstances shall CVG be liable for any incidental, special, indirect or consequential damages arising out of or relating to this license, including but not limited to, any lost profits, business interruption, loss of programs or other data, or all other commercial damages or losses, even if advised of the possibility thereof.

## No Maintenance Services

You understand and agree that CVG is under no obligation to provide either maintenance services, update services, notices of latent defects, or corrections of defects with regard to the Dataset.
CVG nevertheless reserves the right to update, modify, or discontinue the Dataset at any time.

## Publication with MMM and Attribution

This dataset is provided under the CC BY-NC 4.0 license, which requires you to give appropriate credit.
